UK SMS Marketing Terms

1. Scope and operator

These UK SMS Marketing Terms (“SMS Terms”) govern the optional SMS marketing programme operated by Our Place U.K. Limited ("Our Place", "we", "us"). Our full company details and contact address are in section 10.

By enrolling in the programme, you agree to these SMS Terms. Participation is voluntary, and consent to receive marketing text messages is not a condition of purchasing any product or using any service. Acceptance of these SMS Terms alone does not enroll you in the programme. These SMS Terms govern the SMS marketing programme only. Our website, products and purchases remain subject to our International Terms of Service and Sale. If these SMS Terms conflict with our International Terms of Service and Sale, these SMS Terms control solely with respect to the programme.

2. Eligibility and mobile number

You must be at least 18 years old and the subscriber or authorised user of the mobile number used to enroll. You must provide a valid mobile number. You may be added to the programme through an affirmative opt-in, or where the law permits us to market to you as an existing customer. These SMS Terms apply either way. If you stop using or controlling that number, you should unsubscribe before doing so or notify us at hello@fromourplace.co.uk. Consent applies only to the mobile number provided when you enroll and does not transfer to another person or number.

3. Marketing messages

After enrolling, you may receive recurring marketing and promotional text messages from or on behalf of Our Place. These may include product announcements, offers, promotions, back-in-stock notices, event information, cart reminders and other marketing about Our Place products and services. Messages may be personalised. Each marketing message will identify Our Place. Message frequency varies. Offers and promotions sent by text message may be subject to additional terms, eligibility criteria, time limits and availability, and may be corrected or withdrawn.

4. Charges and availability

Our Place does not charge you to participate in the programme. Standard message, data or other network charges may apply under your mobile plan. Contact your mobile network provider for information about applicable charges. Message delivery depends on mobile networks and systems outside our reasonable control. Messages may be delayed, filtered or undelivered. To the extent permitted by law, we are not responsible for delivery failures caused by your device, mobile network provider or other circumstances outside our reasonable control. Nothing in these SMS Terms affects your statutory rights or excludes liability that cannot lawfully be excluded.

5. Withdrawing consent and opting out

You may withdraw your consent and stop receiving marketing text messages at any time. Each marketing text message will provide a simple way to unsubscribe. You can unsubscribe by replying STOP to any marketing text message. Depending on how the message is sent, you may be able to unsubscribe by selecting the unsubscribe link in the message or following other instructions provided in the message.

You may also unsubscribe by emailing hello@fromourplace.co.uk and providing the mobile number receiving the messages. We will stop sending marketing text messages promptly after receiving your request. We may send one non-promotional message confirming that your request has been processed.

Unless you tell us that you object to all direct marketing, an unsubscribe request submitted through the programme applies to marketing by SMS. It does not automatically unsubscribe you from marketing through another channel. You may continue to receive non-promotional messages concerning an order, delivery, account, product safety matter or other transaction. Messages sent by a delivery provider may have their own unsubscribe instructions. You will receive further marketing text messages only if you subsequently opt in again.

For assistance with the programme, follow any help instructions provided in a message, reply HELP to any message, or contact hello@fromourplace.co.uk.

7. Privacy and service providers

We process personal information associated with the programme, including your mobile number, marketing preferences, consent records and interactions with our messages, as described in our Privacy Policy. We may use affiliates and service providers to administer the programme and send messages on our behalf. We may provide them with personal information necessary to perform those services, subject to applicable data-protection requirements and our agreements with them. Some of these providers are located outside the UK; where we transfer personal information outside the UK we put in place appropriate safeguards, as described in our Privacy Policy. You may object at any time to our use of your personal information for direct marketing by contacting us at hello@fromourplace.co.uk.

8. Changes to or discontinuation of the programme

We may change, suspend or discontinue the programme or any of its features at any time. As the programme is a free and optional service, doing so will not affect any order you have already placed or any of your other rights. We may also update these SMS Terms by posting an updated version and revising the “Last updated” date. If you do not agree to an updated version, you may unsubscribe at any time. Where required, we will provide additional notice of material changes or obtain new consent before materially expanding the marketing covered by your existing consent. Changes do not limit your right to unsubscribe at any time.

9. Governing law and general

These SMS Terms are governed by the laws of England and Wales. The courts of England and Wales will have jurisdiction, except that consumers residing in Scotland or Northern Ireland may also bring proceedings in their local courts. You retain the benefit of any mandatory consumer protections that apply where you live. If any provision of these SMS Terms is found to be unenforceable, the remaining provisions continue to apply. We may transfer our rights and obligations under these SMS Terms to another Our Place group company, or in connection with a reorganisation or sale of our business, provided this does not affect your rights under these SMS Terms.
